Terms of Use

This eWallet User Agreement ("Agreement") is a contract between you and Ewallet Direct ("Ewallet Direct"),  and sets forth the legal terms and conditions of your use of the eWallet services offered by Ewallet Direct (the "Service")

Using the online Service provided through the Ewallet Direct website is subject to full compliance with the Ewallet Direct User Agreement. Your use of the Ewallet Direct website shall be deemed an assent and agreement to this Agreement with all of the terms and conditions contained in it, as well as any applicable agreements and policies to be published on https://www.ewallet.direct/chp/web , including, without limitation, the Ewallet Direct Privacy Policy.

In this Agreement, "you" or "your" means you, the person or entity that is, at the relevant time or times, a User of the Service and that is bound by this Agreement. Unless otherwise stated, "Ewallet Direct", "we" or "our" will refer collectively to Ewallet Direct, its officers, directors, agents, subsidiaries, joint ventures, employees and suppliers. Ewallet Direct may amend this Agreement at any time by posting a revised version on our website. The revised version will be effective at the time and date that it is posted. We will provide you with 30 days' prior notice of any change to this Agreement by posting a notice on our website. It is your responsibility to review the terms periodically.

This is an important document which you must consider carefully when choosing whether to use the Services of Ewallet Direct. We, at Ewallet Direct may close, suspend, or limit your access to your Account or the Ewallet Direct Services, and/or limit access to your funds if you violate this Agreement and/or any other agreement you enter into with Ewallet Direct and/or any Ewallet Direct policy. You are solely responsible for understanding and complying with any and all laws, rules and regulations of every jurisdiction or country that may be applicable to you in connection with your use of the Ewallet Direct Services, including but not limited to, those related to export or import activity, taxes or foreign currency transactions.

You agree to be bound by all the conditions set out in this User Agreement and you acknowledge that you were made aware of them before opening an account with Ewallet Direct. By continuing to use the Services of Ewallet Direct you are deemed to accept this Agreement and all policies of Ewallet Direct.

1.0 Definitions

The following words and phrases used in this Agreement shall have the meaning set forth:


means a Ewallet Direct virtual ewallet account.

Account Profile

means the location on our website where you can, after logging in, view and manage your profile, including your personal information, your personal banking account details and your Account settings.

Account Limitation

An account status in which a User has limited or no access to the Services pending an investigation. This status can be either temporary or permanent depending on the individual circumstances.


Automated Clearing House; localized bank transfers in North America.

Add Funds / Funding or "Cash In"

means your ability to transfer money to your Ewallet Direct Account by bank wire transfer.


means Anti-Money Laundering


A form certifying a person's identity by signature or oath in an official capacity.

Authorize or Authorization

means a payer's express authorization to a Merchant to collect a payment from the payer's Ewallet Direct Account.

Bank Deposit Code/ ‘Swift' Code

A Bank Deposit Code is created once a member completes a bank deposit. Bank Deposit Codes are issued to all bank accounts outside of United States and Canada. This code is required when the member visits their bank and must be included in the "Details" or "Reference" area of the bank transfer. No information other than the Bank Deposit Code should be entered in the "Details" or "Reference" area of the bank transaction. A missing Bank Deposit Code may cause delays in completing the transaction.

Business Days

means days that are Monday through Friday except statutory holidays that are observed in St. Lucia.

Change/Cancellation Fee

Fee that applies if you request a change or cancellation of a payment that has already been sent.


means a challenge to a payment that a User files directly with Ewallet Direct.


means any Account or transaction information that we provide to you, including: any Policies you agree to, including updates to these Policies; annual disclosure; transaction receipts or confirmations; Account statements and history.

A "Dispute" is any claim or controversy of any kind between you and us. The term Dispute is to be given its broadest possible meaning and includes, without limitation, all claims or demands (whether past, present, or future, including events that occurred prior to your application for an e-Wallet account and whether or not an account is provided to you, based on any legal or equitable theory (contract, tort, or otherwise) and regardless of the type of relief sought (i.e., money, injunctive relief, or declaratory relief). A Dispute includes, by way of example and without limitation, any claim based upon a federal or provincial constitution, statute, ordinance, regulation, or common law, and any issue concerning the validity, enforceability, or scope of this arbitration agreement.

Due Diligence

means the Time and effort all members are expected to spend on researching the reliability, credibility and ethics of individuals and/or businesses with which they plan on doing business. Members should contact these people or companies to establish a rapport and/or read blogs, reviews, brochures and other material and use their best judgment before doing business with them.


Electronic Funds Transfer; bank transfers and bank wires.

Email Validation

Before a User can login to their Ewallet Direct account, they must click the link in the validation email received during new account registration.


means a processing error made by us or our service providers in which your Account is mistakenly debited or credited.

means an international EFT; a system of transferring money within the financial institutions of a country, such as banks, authorizing the debit of a specified sum from one's own account to the credit of the payee's account

means any Account information that you provide to us, including but not limited to personal information, financial information, or other information related to you or your business.

Manual Handling Fee

means a fee for transactions that are processed manually from Ewallet Direct, which can be a request initiated by a User or by Ewallet Direct Customer Service.

Mass Pay

means a "Send Money" feature can be used to pay several people or a large group at one time. This is a fast and effective tool for members who make weekly pay-outs such as commissions.


Multi-Level Marketing


means a function that allows a member to convert funds from one currency to another. The currency exchange is adjusted regularly.


means an alpha-numeric code each Ewallet Direct member will use to log into their account.

Payment Method

means the payment method used to fund a transaction.

Payment Processing

means a general business category including third-party electronic payment solutions.


means the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (Canada) and similar legislation in any other relevant jurisdiction.

Policy or Policies

means any policy of ours that is set out in the Ewallet Direct website, and/or any agreements between you and Ewallet Direct that have been entered into via the Ewallet Direct website, or otherwise in connection with your use of the Ewallet Direct Service.

Providing Failure Fee

means a fee for not providing up-front documents on payments US$ 10,000 and higher, as required.

Proxy Server

means in computer networks, a proxy server is a server (a computer system or an application program) that services the requests of its clients by forwarding requests to other servers. Members who try to access their Ewallet Direct account through a proxy server will be denied access. They must contact their Internet Service Provider to disable their proxy server.

Restricted Activities

means those activities described in this Agreement.


means we reverse a payment you received because (a) it was sent to you in Error by us, (b) the sender of the payment did not have authorization to send the payment, (c) you received the payment for activities that violated this Agreement, the Ewallet Direct Use Policy, or any other Policy, or (d) we decided a Claim against you.

Screen Shot

means an image capture of a computer screen. The "Prt Scr" button on the keyboard will take a screen shot. You can then paste that screen shot by selecting "Paste" under the "Edit" tab in any program that allows an image to be pasted and saved.

Send Money

means a function that enables a Ewallet Direct User to send funds to another Ewallet Direct User using their name and Ewallet Direct account details. Both the receiver and the sender of the funds must be Ewallet Direct Users.

Substantial Change

means a change to the terms of this Agreement that reduces your rights or increases your responsibilities.


means a Ewallet Direct customer with an active Ewallet Direct account.

Verified Account

means an Account status that reflects our verification that an Account holder has legal control of one or more of his or her Payment Methods. A Verified Account status does not constitute an endorsement of a User or a guarantee of a User's business practices. Account verification identifies the User as part of a Know Your Customer (KYC) and Customer Identification Program (CIP) policy. Verification is important for the Ewallet Direct network as it enhances security and helps to protect our Users against fraud and money laundering. It also ensures Ewallet Direct's full compliance with the Bank Secrecy Act, proceeds of crime in Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF) Regulations and other legislation similar to PCMLTFA.

We, Us or Our

means Ewallet Direct.

Withdraw / "Cash Out"

means a function in which a Ewallet Direct User can transfer funds out of their Ewallet Direct account by bank wire transfer.

Ewallet Direct

means the online fund remittance services provided and offered by Ewallet Direct through https://www.ewallet.direct/chp/web .

Ewallet Direct Services or Service

means all products and services and any other features, technologies and/or functionalities offered by Ewallet Direct on its website or through any other means.

2.0 Operations Relationship
Ewallet Direct provides the Service, i.e., third-party payment processing services and related actions on your behalf. At all times, your funds are held separately from those of our corporation and are not incorporated into or used for Ewallet Direct's operating expenses or corporate purposes. You acknowledge that Ewallet Direct offers an electronic payment Service and is not a bank. Our Service facilitates a display of your electronic transactions.

By initiating and sending payments through the Service or adding funds to your balance, you appoint Ewallet Direct as your agent to obtain the funds on your behalf and transfer them to the designated receiver. When a payment is made, Ewallet Direct processes the funds on your behalf through the banks or institutions that hold your funds. You will not be able to withdraw those funds or send those funds to any other User unless the initial transaction is verified.

When you receive funds through the Service, Ewallet Direct processes the funds on your behalf through the banks or financial institutions that hold your funds. Funds received in your account are held in pooled bank or financial institution accounts.

Ewallet Direct is an electronic payment processor that hosts, creates, maintains and provides the Service to you online. We do not have any control over or cannot ensure that inter transfers between other Ewallet Direct Users will complete their transaction as we are not a party to any transaction between Users. Instead, each Ewallet Direct User agrees to use the Service of their own accord. Furthermore, Ewallet Direct reserves the right to correct any Errors that may occur.

3.0 User Warranties and Representations

You represent and warrant that all of the following are true of you and your affiliates from your entry into this Agreement until the termination of your Account:

  • If you are an entity other than an individual, you have the legal capacity to enter into this Agreement and perform the obligations represented within it.
  • You declare that you are at least 18 years old at the time of registering an account and you acknowledge that Ewallet Direct reserves the right to ask for official personal identification documents for the purpose of verification and you represent that you do not require the consent, approbation or approval of any other person or entity to conclude a contractual obligation of the type represented in this Agreement.
  • You warrant that you are the beneficial owner of the Ewallet Direct Account, and that you are conducting transactions solely on your own behalf and not on behalf of any third party.
  • You represent that you are not violating any laws or regulations of your own country or residence or of any other country by using Ewallet Direct's Service. Not respecting this clause will lead to your account closure and you will hold all legal responsibility, including the liability indemnity to Ewallet Direct for any and all possible losses arising from such violation.
  • You understand and agree that Ewallet Direct accounts are non-transferable and under no circumstances are to be transferred or assigned to a third party or legal entity.
  • You acknowledge that you must comply with security, password protection and identity protection recommendations provided by Ewallet Direct and by following its guidelines.
  • You represent that you will do no act to undermine the value and reputation of Ewallet Direct.
  • You represent that you will conduct your business affairs according to the terms and intent of this Agreement and in compliance with all applicable laws and regulations.
  • You represent that you will not use our Services for any activities considered fraudulent or illegal under any laws or regulations in any applicable jurisdiction.
  • You represent that you will not permit or authorize any other person or entity to use our Services without our written consent.

4.0 Account Types
Ewallet Direct offers two (2) account types:

  • Personal Account: to be used by individuals for personal non-commercial use.
  • Business Account: to be used for business owners, planning to use Ewallet Direct as a payment option on their website.

Choosing the appropriate account type is important to avoid additional fees. Failure to select the appropriate account can result in closure of your account or additional fees being charged to your account or equivalent currency.

5.0 Account Verification

Ewallet Direct encourages Users to become verified for the security of our network. We ask our Users to become verified to comply with the Bank Secrecy Act, the Patriot Act and any other applicable Anti-Money Laundering (AML) and Counter- Terrorism Financing (CTF) Legislation, including PCMLTFA. You agree to complete account verification procedures when you register for a new account. If you refuse to complete account verification, your account may be suspended regardless of any or all pending or unsettled transactions, so that Ewallet Direct will not be out of compliance with any such legislation.

You authorize Ewallet Direct, directly or through third parties, to make necessary inquiries to verify your identity. However, Ewallet Direct cannot and does not guarantee any Ewallet Direct User's identity. Ewallet Direct makes no representation or warranty to you regarding the identity of any Ewallet Direct User.

5.1 Personal Account Verification

We will ask you to complete the necessary verification measures to authenticate your personal identity for your Personal account.
Identity verification measures include all of the following documents:

      • Valid Government Issued Photo Identification / Attestation of Identity
      • Proof of Residential Address with a utility bill statement of within 3 months from the date of issue
      • Social Security Number (SSN) - US only 

5.2 Business Account Verification

To verify your Business Account, in addition to submitting a proof of residential address and attestation of photo identity, you will be required to submit a Proof of Ownership for your business and provide any one of the following documents:

      • Articles of Incorporation, Articles of Amalgamation, etc.
      • Letter of Good Standing from the bank transacting your business account
      • General Business Registration
      • Doing Business As (DBA) - if applicable to you
      • Tax Registration identification number

5.3 File Type for the Submission Documents & Digital Photographs

We accept documents that are digitally photographed, scanned, or photocopied, in any of the following file formats: JPG, GIF, PNG, TIF, BMP, and PDF. You can also provide digital documents though services other online User sites offer.

*File size should be under 2MB, and larger than 320 x 240 pixels in dimension.

The following are a few suggestions when submitting your documents by digital photographs using digital cameras or mobile phones

      • Set your camera to Macro Mode
      • Start by placing the camera as close to the document as possible, and gradually pull away until the picture is not blurry.
      • Do not use flash - using them may cause reflection glares.

6.0 Account Activity

6.1 Adding Funds to Your Account

You can add funds (‘Cash In') to your Ewallet Direct account by bank wire transfer, according to the Ewallet Direct services available in your country. Once you have funded your Ewallet Direct account, you can use the Ewallet Direct services.

If you have any questions regarding an "Add Funds" / "Cash In" transaction, contact Ewallet Direct Customer Support. DO NOT CONTACT Ewallet Direct's banking partners because they will not be able to help you with any transactions since they do not have access to any of your account information or Ewallet Direct system platform. If you do contact our banking partners, fines will be applied to your Ewallet Direct account.

IT IS STRICTLY FORBIDDEN TO DEPOSIT CASH to your Ewallet Direct account and will result in immediate account termination. This is for PCMLTFA compliance reasons. For security and compliance reasons, Ewallet Direct does not allow third parties to add funds to Ewallet Direct accounts. If funds are added from a bank account that does not list your name or your company as the primary holder, the transaction will be subjected to an additional security review and administrative fee.

6.2 Set-off of Past Due Amounts

If you have a past due amount owed to us or a Ewallet Direct affiliate, subsidiary, or parent company, we may debit your Account to pay any amounts that are more than 90 Days past due.

6.3 Negative Balances and Multiple Currencies

If your Account has a negative balance, we may set-off the negative balance with any funds that you subsequently add or receive into your Account. If you have multiple currency balances in your Account and one of the currency balances becomes negative for any reason, we may set-off the negative balance by using funds you maintain in a different currency balance.

6.4 Withdrawing Funds

You can withdraw funds ("Cash Out") from your Ewallet Direct account by bank wire transfer, according to the Ewallet Direct services available in your country. You may withdraw funds from your Account in any of these methods:

(a) by electronically transferring funds to Accounts held by other Ewallet Direct Users; or 
(b) by electronically transferring funds to your personal bank account that is not your Ewallet Direct Account.
If you have any questions regarding a "Withdraw Funds" / "Cash Out" transaction, contact Ewallet Direct Customer Support. DO NOT CONTACT Ewallet Direct's banking partners because they will not be able to help you with any transactions since they do not have access to any of your account information or to the Ewallet Direct system platform. If you do contact our banking partners, administrative fees may be applied to your Ewallet Direct account.

For security and compliance reasons, if funds are transferred to a bank account that does not list your name or your company as the primary holder, the transaction will be subjected to an additional security review and administrative fee.

6.5 Closing Your Account

You may close your Account at any time. Upon Account closure, we will cancel any pending transactions and you will forfeit any balances associated with Redemption Codes, unless otherwise legally prohibited. You must withdraw your balance prior to closing your Account.

6.6 Limitations on Closing Your Account

You may not evade an investigation by closing your Account. If you close your Account while we are conducting an investigation, we may hold your funds to protect Ewallet Direct, subsidiaries and affiliates or a third party against the risk of Reversals, Claims, fees, fines, penalties and other liability. You will remain liable for all obligations related to your Account even after the Account is closed.

6.7 Account Balances

You are not required to carry a balance in your e-wallet. You may load funds at any time. However, if your account has a negative balance, you agree to load funds into your account forthwith to cover the negative balance. If you do not, we reserve the right to recover the funds by any means necessary, including the involvement of a collection agency or law enforcement agency. If you do hold a balance in your e-wallet, at all times, your funds will be held separately from those of our corporation and will not be incorporated into or used for Ewallet Direct's operating expenses or corporate purposes.

You further understand that you will not receive interest or other earnings on the funds that Ewallet Direct processes on your behalf through pooled bank or financial institution accounts. In consideration for your use of the Service, you irrevocably transfer and assign to Ewallet Direct any ownership right that you may have in any interest that may accrue on funds held in pooled bank or financial institution accounts. This assignment applies only to interest earned on your funds, and nothing in this Agreement grants Ewallet Direct any ownership right to the principal of the funds. In addition to or instead of earning interest on pooled bank or financial institution accounts, Ewallet Direct may receive a reduction in fees or expenses charged to it by banking services by the banks or institutions that hold your funds.

7.0 Errors and Unauthorized Transactions

7.1 Protection for Unauthorized Transactions and Errors

When an Unauthorized Transaction or an Error occurs in your Account, we will cover you for the full amount of every eligible Unauthorized Transaction or Error so long as you follow the procedures discussed below.
An "Unauthorized Transaction" occurs when a payment is sent from your Account that you did not authorize and that did not benefit you. For example, if someone steals your password, uses the password to access your Account, and sends a payment from your Account, an Unauthorized Transaction has occurred. If you give someone access to your Account (by giving them your login information) and they conduct transactions without your knowledge or permission, you are responsible for any resulting use and loss.

7.2 Notification Requirements

You agree to immediately notify us if you believe that any of the following have occurred:

        • there has been an Unauthorized Transaction or unauthorized access to your Account;
        • there is an Error in your Account history statement
        • your password has been compromised; or
        • you need more information about a transaction listed on the statement or transaction confirmation.

You acknowledge that to be eligible for protection for Unauthorized Transactions, you must notify us within ten (10) Days after any Unauthorized Transaction first appears in your Account history statement. Failure to notify us within that time shall be deemed a waiver of any claim for an Unauthorized Transaction.

You agree to regularly log into your Account and review your Account history statement to ensure that there has not been an Unauthorized Transaction or Error. We will also send an email to the primary email address you have provided in order to notify you of each transaction from your Account. You should also review these transaction confirmations to ensure that each transaction was authorized and is accurate.

7.3 Content of Notice

When you notify us, provide us with all of the following information:

  • Your name and email address registered to your Account;
  • A description of any suspected Unauthorized Transaction or Error and an explanation as to why you believe it is incorrect or why you need more information to identify the transaction; and
  • The amount of any suspected Unauthorized Transaction or Error.

If you notify us orally, we may require that you send us your complaint or question in writing within ten (10) Business Days. During the course of our investigation, we may request additional information from you.

7.4 Response to Your Notification

Once you notify us of any suspected Unauthorized Transaction or Error, or we otherwise learn of one, we will do the following:

  • We will conduct an investigation to determine whether there has been an Unauthorized Transaction or Error that is eligible for protection.
  • We will complete our investigation within ten (10) Business Days of the date we received your notification of the suspected Unauthorized Transactions or Error. If your Account is new (i.e., the first transaction from your Account was less than 30 Business Days from the date you notify us), we may take up to 20 Business Days to complete this investigation. If we need more time, we may take up to 45 Days to complete our investigation (or up to 90 Days for new Accounts).
  • We will inform you of our decision within 3 Business Days after completing our investigation. If we determine that there was an Unauthorized Transaction or Error, we will promptly credit the full amount into your Account within 3 Business Day of our determination. If we decide that there was not an Unauthorized Transaction or Error, we will include an explanation of our decision in our email to you.

7.5 Errors by You

If you erroneously send a payment to the wrong party, or send a payment for the wrong amount (based on a typographical error, for example), your only recourse will be to contact the party to whom you sent the payment and ask them to refund the payment. We will not reimburse you or reverse a payment that you have made in error.

8.0 Restricted Activities

8.1 Acceptable Use Policy ("AUP")

Use of the Ewallet Direct services is subject to the Acceptable Use Policy ("AUP") between an authorized User ("You") and Ewallet Direct. In connection with your use of our website, your Account, the Ewallet Direct services, or in the course of your interactions with Ewallet Direct, other Users, or third parties, you agree that will not:

  • Breach this Agreement, the Use Policy or any other Policy that you have agreed to with us;
  • Violate any law, statute, ordinance, or regulation;
  • Infringe our or any third party's copyright, patent, trademark, trade secret or other intellectual property rights, or rights of publicity or privacy;
  • Act in a manner that is defamatory, trade libelous, threatening or harassing;
  • Provide false, inaccurate or misleading Information;
  • Engage in potentially fraudulent or suspicious activity and/or transactions;
  • Refuse to cooperate in an investigation or provide confirmation of your identity or any Information you provide to us;
  • Control an Account that is linked to another Account that has engaged in any of the Restricted Activities;
  • Conduct your business or use the Ewallet Direct Services in a manner that results in or may result in complaints, Disputes, Claims, Reversals, fees, fines, penalties and other liability to Ewallet Direct, other Users, third parties or you;
  • Use your Account or the Ewallet Direct Services in a manner that Ewallet Direct, or any other applicable electronic funds transfer network reasonably believes to be an abuse of the system or a violation of network rules;
  • Disclose or distribute another User's Information to a third party, or use the Information for marketing purposes unless you receive the User's express consent to do so;
  • Send unsolicited email to a User or use the Ewallet Direct Services to collect payments for sending, or assisting in sending, unsolicited email to third parties;
  • Take any action that imposes an unreasonable or disproportionately large load on our infrastructure;
  • Facilitate any viruses, Trojan horses, worms or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or Information;
  • Use an anonymizing proxy; use any robot, spider, other automatic device, or manual process to monitor or copy our website without our prior written permission;
  • Use any device, software or routine to bypass our robot exclusion headers, or interfere or attempt to interfere with our website or the Ewallet Direct Services; or
  • Take any action that may cause us to lose any of the services from our Internet service providers, payment processors, or other suppliers.

8.2 Banned Activities

The following activities are also not allowed through or in relation to Ewallet Direct:

  • Money laundering and / or financing terrorist activities
  • Violating any law, statute, ordinance, contract or regulation, including but not limited to those governing financial services, consumer protection, unfair competition, anti-discrimination or false advertising
  • Submitting altered verification documents
  • Being misleading, false or inaccurate in respect to Ewallet Direct or any other User
  • Spamming (including and not limited to using spam-ware, spy-ware, etc.)
  • Using Ewallet Direct as a virtual terminal
  • Using the Ewallet Direct brand to market or advertise your product(s)/service(s) in any capacity
  • Transmitting personal information of other Ewallet Direct Users to third parties
  • Using or selling any form of e-cash, web cash or other matter, tangible or not, that is redeemable for a product or service from a third party
  • Using the Ewallet Direct brand to market or advertise your product(s)/service(s) in any capacity
  • Threatening legal action against Ewallet Direct and/or Ewallet Direct employees
  • Diluting our traffic by using our trademarks (including but not limited to Ad words, whether as key words, meta-data or otherwise)

The above list of banned activities is not exhaustive, and may be updated at any time in order to satisfy Ewallet Direct's own risk management processes. Furthermore, anything that causes us to lose or become liable for, in whole or in part, the services of our sponsoring banks, Internet Service Providers or other suppliers is not allowed. If you use or attempt to use the Service for purposes other than sending and receiving payments and managing your account, including but not limited to tampering, hacking, modifying or otherwise corrupting the security or functionality of the Service, your account will be terminated and you will be subject to damages and other penalties, including criminal prosecution if necessary.

9.0 Liabilities, Violations and Administrative Fees

If you are found in violation of this Policy and all terms herein, we reserve the right to fine you a penalty of $500 USD and upwards, depending on damages and the severity of the violation and the liability you cause to Ewallet Direct and/or our professional partners. Sites that sell banned products or services are subject to immediate account termination. We also reserve the right to freeze or forfeit funds, as well as fine the account holder and/or cancel payment without notice.

We further reserve the right to levy administrative fees against you for any and all fraudulent or negligent uses of the Service for your business, for excessive refunds, transaction disputes, charge backs and complaints, and for excessive burden, creating liability and damaging our credibility among our Users and professional partners.

9.1 Our Liability; Disclaimer of Warranties

Ewallet Direct is an on-line payment facilitation services provider. Our sole function is to facilitate payments. Accordingly, we make no warranty, express or implied, and it is entirely up to you to satisfy yourself concerning the identity of the persons and companies with which you do business. We take no responsibility and assume no liability with respect to any disputes with persons with whom you choose to do business, or for you, with respect to complaints against you by third parties. We take no responsibility and assume no liability with respect to the intentions, credit-worthiness, bona fides or needs of any person with whom you do business through the use of the Service.


If you have a dispute with one or more Ewallet Direct Users, you release Ewallet Direct from any and all claims, demands and actual/consequential damages related to your transaction(s) with other said Ewallet Direct User(s) and agree to indemnify us for all claims, suits, amounts, fees, damages and costs whatsoever in relation to the dispute. Ewallet Direct makes reasonable efforts to ensure that requests for electronic debits and credits involving bank accounts are processed promptly. We make no representations or warranties regarding the amount of time needed to complete transactions because our Service is largely dependent upon many factors outside of our control.


You agree that if either you or Ewallet Direct begin litigation or arbitration, the prevailing party is entitled to recover reasonable attorneys' fees and any other costs incurred in addition to any other relief to which the prevailing party may be entitled.


9.2 Your Liability

You are responsible for all Reversals, Claims, fees, fines, penalties and other liability incurred by Ewallet Direct, a User, or a third party caused by or arising out of your breach of this Agreement, and/or your use of the Ewallet Direct Services. You agree to reimburse Ewallet Direct, a User, or a third party for any and all such liability. In the event that you are liable for any amounts owed to us, you agree that we may immediately remove such amounts from your balance. If you do not have a balance that is sufficient to cover your liability, your remaining balance (if any) will be removed, your Account will have negative balance up to the amount of your liability, and you will be required to immediately Add Funds to your Balance or reimburse us through an alternative method. If you do not do so, we may engage in collection efforts to recover such amounts from you. If you fail to promptly report Unauthorized Transactions or Errors in your Ewallet Direct account, you will be solely liable for any resulting damages and losses. We will do what we can to recover the funds, but if we are unable to recover them, you will assume responsibility for the losses and will not seek to recover them from us.

Your Ewallet Direct account is protected by a user name and password. As long as you keep the user name and password confidential, no one will be able to access the funds or information in your Ewallet Direct account. If you share your user name or password with others or allow others to discover and use your user name and password with the account, you are giving access to the funds and information in the account and you assume all responsibility for transactions in your account.

10. Liability and Remedies

10.1 Limitation of Liability


10.2 Remedies re: Restricted Activities

If we, in our sole discretion, believe that you may have engaged in any Restricted Activities, we may take various actions to protect Ewallet Direct, its shareholders, subsidiaries and affiliates, other Users, other third parties or you from Reversals, Claims, fees, fines, penalties and any other liability. The actions we may take include but are not limited to the following:

  • We may close, suspend, or limit your access to your Account or the Ewallet Direct Services;
  • We may refuse to provide the Ewallet Direct Services to you permanently both now and in the future; and
  • We may hold your funds for a period of time reasonably needed to protect against the risk of liability to Ewallet Direct or a third party, or if we believe that you may be engaging in potentially fraudulent or suspicious activity and/or transactions.

10.3 Risk-Based Holds

We may, in our sole discretion, place a hold on any or all of the payments you receive when we believe there may be a high level of risk associated with you, your Account, or any or all of your transactions. Our determination may be based on different factors and we may rely on information it receives from third parties. If we place a hold on a payment, the funds will appear in your "pending balance" and the payment status will indicate the hold. If we place a hold on any or all of the payments you receive, we will provide you with notice of our actions. We will release the hold on any payment after 30 Days from the date the payment was received into your Account unless we have a reason to continue to hold the payment such as (a) the receipt of a Dispute, Claim, or Reversal, (b) we believe that you have violated the terms of this Agreement or any other Policy and that such a violation results in the need to continue holding the funds, or (c) we believe that you may be engaging in potentially fraudulent or suspicious activity and/or transactions. In such an event, we may continue holding the payment in your Account until the matter is resolved pursuant to this Agreement. In our sole discretion, we may release the hold earlier under certain circumstances, for example when you upload tracking information of the item you shipped.

10.4 Disputed Transaction Holds.

If a User files a Dispute, Claim, or Reversal on a payment you received, we may place a temporary hold on the funds in your Account to cover the amount of the liability. If you win the dispute or the transaction is eligible, we will lift the temporary hold. If you lose the dispute, we will remove the funds from your Account.

10.5 Reserves

We may, in our sole discretion, place a Reserve on funds held in your Account when we believe there may be a high level of risk associated with your Account. If we place a Reserve in your Account, transactions will be shown as "pending" in your Ewallet Direct balance, and you will not have access to funds in a "pending" status until they are cleared. If your Account is subject to a Reserve, we will provide you with notice specifying the terms of the Reserve. The terms may require that a certain percentage of the amounts received into your Account are held for a certain period of time, or that a certain amount of money is held in Reserve, or anything else that we determine is necessary to protect against the risk associated with your Account. We may change the terms of the Reserve at any time by providing you with notice of the new terms.

10.6 Account Closure, Termination of Service, Limited Account Access; and Confidential Criteria

In our sole discretion, we reserve the right to terminate this Agreement with you and/or access to the Ewallet Direct Service for any reason and at any time upon notice and payment to you of any unrestricted funds held in your balance. If we limit access to your Account, including through a Reserve or hold, we will provide you with notice of our actions, and the opportunity to request restoration of access if, in our sole discretion, we deem it appropriate. Further, you acknowledge that our decision to take certain actions, including limiting access to your Account, placing holds or imposing Reserves, may be based on confidential criteria that is essential to our management of risk, the security of Users' Accounts and the Ewallet Direct system. You agree that we are under no obligation to disclose the details of our risk management or our security procedures to you. 

11.0 Governing Law, Court Proceedings, Damages, Arbitration:  

11.1 Governing Law.

The terms and conditions of this Agreement will be construed in accordance with Canadian law and will be subject to the exclusive jurisdiction of the Canadian courts.
Except as set forth in the Waiver of Jury Trial and Arbitration Agreement below, (1) this Agreement will be governed by, construed and enforced in accordance with federal law and the laws of the Canadian Courts; (ii) any action or proceeding with respect to this Agreement or any services hereunder shall be brought only before a federal or provincial court; and (iii) you agree to pay upon demand all of our costs and expenses incurred in connection with the enforcement of this Agreement. If we are served garnishments, summonses, subpoenas, orders or legal processes of any type, we are entitled to rely on the representations therein and may comply with them in our own discretion without regard to jurisdiction. 

11.2 Arbitration and Waiver of Jury Trial


           You and we agree that any Dispute (defined above) will be resolved by Arbitration.

11.3 Procedure for Demanding Arbitration.

 If a Dispute arises, the party asserting the claim or demand must initiate arbitration, provided you or we may first try to resolve the matter informally or through customary business methods, including collection activity. The party filing an arbitration complaint must choose an arbitration firm that is mutually agreed upon for initiating and pursuing arbitration.  If the parties mutually agree, a private party, such as a retired judge, may serve as the arbitrator. If you claim you have a Dispute with us, but do not initiate arbitration or select an arbitrator, we may do so. You may obtain copies of the current rules of each of the arbitration firms and forms and instructions for initiating arbitration by contacting them.

 In the event an arbitration firm was unavailable to decide a Dispute, the parties agree to select another neutral party experienced in financial matters to decide the Dispute.  If such an independent arbitrator cannot be found, the parties agree to submit any Dispute to a provincial or federal judge, sitting without a jury, for resolution on an individual and not a class-wide basis.

The policies and procedures of the selected arbitration firm will apply provided such policies and procedures are consistent with this arbitration agreement. To the extent the arbitration firm's rules or procedures are different than the terms of this arbitration agreement, the terms of this arbitration agreement will apply.

11.4 Costs of Arbitration.

No matter which party initiates the arbitration, we will advance or reimburse filing fees and other costs or fees of arbitration, provided each party will be initially responsible for its own attorneys' fees and related costs. Unless prohibited by law, the arbitrator may award fees, costs, and reasonable attorneys' fees to the party who substantially prevails in the arbitration.

11.5 Location for Arbitration.
 Unless you and we agree to a different location, the arbitration will be conducted in British Columbia Canada.

11.6 Waiver of Rights

You are waiving your right to a jury trial, to have a court decide your Dispute, to participate in a class action lawsuit, and to certain discovery and other procedures that are available in a lawsuit. You and we agree that the arbitrator has no authority to conduct class-wide arbitration proceedings and is only authorized to resolve the individual Disputes between you and us. The validity, effect, and enforceability of this waiver of class action lawsuit and class-wide arbitration, if challenged, are to be determined solely by a court of competent jurisdiction and not by the arbitrator. If such court refuses to enforce the waiver of class-wide arbitration, the Dispute will proceed in court and be decided by a judge, sitting without a jury, according to applicable court rules and procedures, and not as a class action lawsuit. The arbitrator has the ability to award all remedies available by statute, at law, or in equity to the prevailing party.

11.7 Applicable Law and Review of Arbitrator's Award.

The arbitrator shall apply applicable federal and Provincial Law substantive law and the terms of this Agreement. The arbitrator must apply the terms of this arbitration agreement, including without limitation the waiver of class-wide arbitration. The arbitrator shall make written findings and the arbitrator's award may be filed with any court having jurisdiction. The arbitration award shall be supported by substantial evidence and must be consistent with this Agreement and with applicable law, and if it is not, it may be set aside by a court. The parties shall have, in addition to the grounds referred to in the Federal Arbitration Act for vacating, modifying, or correcting an award, the right to judicial review of (a) whether the findings of fact rendered by the arbitrator are supported by substantial evidence and (b) whether the conclusions of law are erroneous under the substantive Provincial law of and applicable federal law. Judgment confirming an award in such a proceeding may be entered only if a court determines that the award is supported by substantial evidence and is not based on legal error under the substantive Provincial law and applicable federal law.

11.8 Survival.

This arbitration provision shall survive: (1) cancellation, payment, charge-off, or assignment of this Agreement; (2) the bankruptcy of any party; and (3) any transfer, sale, or assignment of this Agreement, or any amounts owed under this Agreement, to any other person or entity.

11.9 Notices to You

You agree that we may provide you communications about your Account and the Ewallet Direct Service electronically. We reserve the right to close your Account if you withdraw your consent to receive electronic communications. Any electronic communications will be considered to be received by you within 24 hours of the time we post it to our website or email it to you. Any notice sent to you by postal mail will be considered to be received by you in three (3) Business Days after we send it.

11.10 Notices to Ewallet Direct

Except as otherwise stated above in section titled Errors and Unauthorized Transactions, notices to us must be sent by postal mail to: Ewallet Direct Pay

12.0 Personal information

Ewallet Direct collects personal information of account holders based on the current laws of the United States and the State of Nevada including, but not limited to the following:

  • Account holders are required to provide valid and accurate personal information during registration for the bank wire funding and withdrawal option provided by Ewallet Direct to be utilized. Ewallet Direct reserves the right to verify all Information provided and copies of personal identification documents and proof of address before an account registration is approved. Failing to comply with this clause could result in immediate suspension of your account to prevent fraudulent activity.
  • The following documents are valid for personal information verification: valid passport, government issued photo identification document or driver's license with photo identification. Documents such as birth certificate, student card, or working badge are all examples of documentation that is NOT acceptable. 
  • The following documents are valid for address verification with a date of issue to you of within 90 days: recent bank or credit card statement or a utility bill such as gas, electricity or telephone at a fixed residential address.
  • Personal information can be changed under the Personal Profile after logging in to your account. If for any reason, it is not possible to change some of the Information, account holders must contact the Ewallet Direct Customer Service department with their updated Information.
  • Account holders must ensure that their account details are reviewed regularly for current updates to ensure they are receiving Ewallet Direct's communications. Ewallet Direct is not responsible for losses caused by account holders failing to comply with this clause. Please note that Ewallet Direct reserves the right to send an account holder occasional emails containing information regarding new features, promotions and special events.
  • Account holder's personal information is kept for a period of up to seven (7) years following the closure of a Ewallet Direct account.

13.0 Account Security
Ewallet Direct provides a secure environment to protect all sensitive Information using advanced 256 bit SSL encryption providing best in class security protection in the following:

  • Account holders must ensure that their login credentials are kept safely and are not shared with third parties.
  • Account holders must ensure the security of their account user name and password, and their challenge phrases.
  • The username and email address is validated with a second step identity confirmation prior to log into the account holder's account.
  • Initial passwords are automatically generated by the Ewallet Direct system and are emailed to the account holder at the time of completion of registration. Once email validation is satisfied, account holder will later have the option to change his or her personal password. (It is recommended that you do so.)

14.0 Privacy Policy

The Ewallet Direct Privacy Policy (the "Policy") describes how Ewallet Direct manages a Ewallet Direct User's personal information. By visiting or using the Ewallet Direct Service website, https://www.ewallet.direct/chp/web or other Ewallet Direct website (each and all, the "Site") and use of any of the associated tools or applications, you, as a User, are expressly agreeing to, and signify consent and acceptance of the Policy. Ewallet Direct is committed to respecting and preserving your privacy at all times and the Policy will inform you of how information is collected, stored, used, and protected as well as the limited circumstances under which a Ewallet Direct User's information may be shared with others. The Policy will also instruct on how you can contact Ewallet Direct regarding questions or concerns relating to the Policy.

The Policy describes the ways Ewallet Direct collects, stores, uses and protects a Ewallet Direct User's personal information. As a User of the Ewallet Direct Service, you accept the Policy and consent to such collection, storage and use when you sign up for and the use of the Ewallet Direct Service, products, or any other feature, technologies or functionalities offered by the Site or through any other means (collectively "Ewallet Direct Services").
Ewallet Direct may amend the Policy at any time by posting a revised version on the Ewallet Direct Site. The revised version will be effective at the time it is posted and will supersede any previous versions of the Policy. In addition, if the revised version includes a substantial change, Ewallet Direct will provide you with 30 days' prior notice by posting notice on our Site. After this 30 days' notice, you, the User, will be considered as having expressly consented to all amendments to the Policy.

14.1 Collection

When you, the Ewallet Direct User, use the Ewallet Direct Site or message a member of Ewallet Direct, the personal information collected that you provide may include:

      • your name, email address, address, contact phone number(s);
      • IP address and standard web log-in information; and
      • Any other information you provide when using the Site.

Our servers are located in various places, including the "cloud". If you choose to provide personal information, then you are consenting to the transfer and storage of that information on Ewallet Direct servers.

14.2 Use

A User's personal information is used to:

      • provide the Ewallet Direct Service;
      • resolve disputes, troubleshoot problems and enforce our policies;
      • customize a User's experience, inform Users about services and updates, and measure interest in the Ewallet Direct Services;
      • communicate with Ewallet Direct Users about Site updates and information; and/or
      • send Ewallet Direct Service and Site related information.

14.3 Disclosure

Ewallet Direct does not sell or rent a User's personal information to third parties for their marketing purposes without a User's explicit consent. Ewallet Direct may combine a User's information with information collected from other companies and use it to improve and personalize the Ewallet Direct Services, content and advertising. If you do not wish to receive marketing communications from Ewallet Direct or participate, then indicate your preference by following the unsubscribe/opt out directions provided with the communication. Ewallet Direct may disclose a User's personal information to respond to legal requirements, enforce Ewallet Direct policies, respond to claims that a User's activity may violate another Users' rights, or protect all User's rights, property, or safety. Ewallet Direct may also share a User's personal information with service providers who help with our business operations and with members of our corporate family who may provide joint content and services and help detect and prevent potentially illegal acts.

14.4 Access, Modification, and Deletion

Except as required by applicable laws, Ewallet Direct will delete a User's personal information when it no longer is needed for the purposes described above or for any other purposes the User may authorize. We retain a User's personal information as permitted by law to resolve disputes and enforce our policies. 14.5 Security

Ewallet Direct uses the industry standard protection tools (encryption, passwords, physical security) to protect a User's personal information against unauthorized access and disclosure, but Ewallet Direct does not guarantee, and you, as a User, should not expect that your personal information will remain private. Ewallet Direct is not responsible for any privacy policies or data practices of any third party websites, including without limitation any social networking website or service.

14.6 How a User's information is Collected

When a Ewallet Direct User visits and logs in or accesses the Ewallet Direct Site or uses the Ewallet Direct Services, Ewallet Direct collects that User's IP address and standard web login information, such as the web browser type and the pages a User has accessed on the Ewallet Direct Site. If you open an account and use the Ewallet Direct Services, the following types of information, but not limited to this list, is collected:

  • Contact information – full name, address, phone, email and other similar information.
  • Valid government issued photo identification.
  • Proof of Address.
  • Financial information - the full bank account numbers that is linked to your Ewallet Direct account or provide to Ewallet Direct when you use the Ewallet Direct Services.
  • "Know Your Customer" (KYC) information for AML and similar regulatory compliance purposes.

Before you can access and use the Ewallet Direct Services, you must provide additional information that we can use to verify your identity or address or manage risk, such as your date of birth, valid government issued photo identification and proof of address. Ewallet Direct may also obtain information pertaining to you from third parties such as credit bureaus and identity verification services.

When a Ewallet Direct User is using the Ewallet Direct Services, Ewallet Direct collects information about a User's account electronic transactions and may also collect information about a User's computer or other access devices used to access the Ewallet Direct Services for fraud prevention purposes. Ewallet Direct may also collect additional information from a User in other ways, such as through contacts with the Ewallet Direct Customer Support Team, results of surveys and interactions with any member of the Ewallet Direct corporate family or other companies.

14.7 How Cookies Are Used

When a Ewallet Direct User accesses the Ewallet Direct Site, Ewallet Direct, or companies that are hired to track how the Ewallet Direct Services are used, may place small data files called "cookies" on your computer. A "cookie" is sent to your computer when you log in to the Site and access your account, or otherwise use the Ewallet Direct Services. This type of cookie helps Ewallet Direct to recognize you, as a valid User, and when multiple web pages are visited on the Ewallet Direct Site during the same session, so that you are not asked for your personal password on each page. Once you log out or close the web browser, this cookie expires and no longer has any effect.

Ewallet Direct may also use longer-lasting cookies for other purposes such as to display your e-mail address on the sign-in form, so that you don't need to retype the e-mail address each time you log in to your account. Ewallet Direct encodes the cookies so that only Ewallet Direct can interpret the information stored in them. You are free to decline the Ewallet Direct cookies if your browser permits, but doing so may interfere with the use of the Ewallet Direct Site and Services or products offered by Ewallet Direct. Ewallet Direct and our service-providers also use cookies to customize the Ewallet Direct Services, content and advertising, measure promotional effectiveness, and promote trust and safety.
You may also encounter cookies from third parties when using the Ewallet Direct Services on websites that we do not control (for example, if you view a webpage created by a third party or use an application developed by a third party, there may be a cookie placed by that web page or application).

14.8 How We Protect and Store Personal Information

Throughout this policy, the term "personal information" is used to describe information that can be associated with a specific person and is used to identify that person. Ewallet Direct does not consider personal information to include information that has been anonymized so that it does not identify a specific individual.

Ewallet Direct will store and process a User's personal information on computers and elsewhere in the world where Ewallet Direct has facilities. Ewallet Direct protects that personal information by maintaining physical, electronic and procedural safeguards in compliance with applicable law. Ewallet Direct uses computer safeguards such as firewalls and data encryption, restricts physical access to our buildings and files, and restricts access to personal information so that only those employees who require it to fulfill their job responsibilities have such access.

14.9 How a User's Personal Information That is Collected is Used

The primary purpose for collecting a User's personal information is to provide a safe, smooth, efficient, and customized experience using the Ewallet Direct Services and the Site. To that end, a User's personal information is used to:

  • provide the Services and customer support that is requested;
  • process transactions and send notices about electronic transactions;
  • resolve disputes, collect fees, and troubleshoot problems;
  • prevent potentially prohibited or illegal activities, and enforce the Agreement;
  • customize, measure, and improve the Ewallet Direct Services and the content and layout of the Site;
  • deliver targeted marketing, service update notices, and promotional offers based on a Ewallet Direct User's communication preferences; and
  • compare information for accuracy and verify it with third parties.

14.10 How a User's Personal Information is Shared With Other Ewallet Direct Users

To process requested electronic transfer requests, Ewallet Direct must share some of a User's personal information with the person or beneficiary that the User is sending funds to or receiving funds from. Information shared includes a User's contact information, the transaction date, the amount of the transaction, and whether the User has verified control of an external personal bank account that has been provided to Ewallet Direct when an account is opened with Ewallet Direct to transact through the Ewallet Direct Services.

Ewallet Direct works with third parties to enable them to accept or facilitate payments from or to a Ewallet Direct User using the Ewallet Direct Service. In doing so, a third party may share information about a Ewallet Direct User with us, such as an email address or phone number to inform or confirm that an electronic transaction that you had requested is processed through that third party service. Ewallet Direct uses your personal information to confirm that you are a valid Ewallet Direct User. Ewallet Direct will send a notification message to you that the electronic transaction you requested is made and processed.

14.11 How Personal Information is Shared With Others

Ewallet Direct may share a User's personal information with:

  • Members of the Ewallet Direct Inc. corporate family – like https//www.ewallet.direct – to provide joint content, products and services (like registration, transactions and customer support), to help detect and prevent potentially illegal acts and violations of our policies, and to guide decisions about products, services and communications. Member of the Ewallet Direct corporate family will use this information to send marketing communications.
  • Service providers under contract who help with parts of Ewallet Direct business operations; (fraud prevention, bill collection, marketing, technology services). The contracts dictate that these service providers only use a User's information in connection with the services they perform for Ewallet Direct and not for their own benefit.
  • Companies that Ewallet Direct plans to merge with or be acquired by (should such a combination occur) Ewallet Direct will require that the new combined entity follow the Policy with respect to protecting a Ewallet Direct User's personal information. If a User's personal information could be used contrary to the Policy, you, the User, will receive prior notice and an opportunity to withdraw consent.
  • Law enforcement, government officials, or other third parties when:
    • Ewallet Direct is compelled to do so by a subpoena, court order or similar legal procedure;
    • Ewallet Direct needs to do so to comply with applicable law;
    • Ewallet Direct believes in good faith that the disclosure of a User's personal information is necessary to prevent physical harm or financial loss, to report suspected illegal activity, or to investigate violations of the Agreement.
  • Other third parties with a User's consent or direction to do so.


There may be links to other websites on the Ewallet Direct Site which may or may not have a privacy policy. Ewallet Direct is not responsible for the collection, use or disclosure of information collected through third party websites or application and expressly disclaim any responsibility or liability related to such collection, use or disclosure. Please note that these third parties may be in other countries where the laws on processing personal information may be less stringent than in your country.

15.0 Transactions

Account holders have access to all transactions carried out with their account as well as any fees involved. See Fees. Any possible irregularities are to be reported by contacting Ewallet Direct Customer Service department on the Contact Us located on our website https://www.ewallet.direct/chp/web or by email at  admin@ewallet.direct In using the Ewallet Direct services, you agree to each of the following:

  • Each Ewallet Direct account is attached to one e-mail address which identifies the Ewallet Direct User. When arranging a funds transfer transaction, a Ewallet Direct User must include the recipient's exact Ewallet Direct User name and the recipient's Ewallet Direct account.
  • Ewallet Direct does not hold the responsibility for spelling errors of personal information made by a Ewallet Direct User arranging an internal Ewallet Direct transaction to another Ewallet Direct User. Personal information for a recipient of a transaction includes the correct numbers of the recipient's account details and/or correct spelling of the recipient's name.
  • Ewallet Direct does not have responsibility for any type of damage or loss caused by payments made to the wrong recipients, payments made for incorrect amounts, payments made by third parties through an account holders account, delays or data loss caused by telecommunications systems, government acts, fraud or an act that is unequivocally illegal or completely wrongful of the account holder.
  • In case of suspicious/fraudulent funds, Ewallet Direct reserves the right to put such transactions on hold for further investigation.
  • Transactions, funding and withdrawals are subject to charges and fees. For more information and details regarding Ewallet Direct fees please see Fees section.
  • A recipient's account will be credited with the proper amount, once the sender confirms the transaction.
  • Ewallet Direct account holders can withdraw funds from Ewallet Direct accounts by using the Ewallet Direct Service. Times to complete a withdrawal may vary due to security reasons, amount being transferred and/or account validation.
  • All transactions are final, irreversible and possible misunderstandings between a Ewallet Direct User and another Ewallet Direct and transaction disputes shall be acknowledged and resolved between them, except in the case of fraudulent use of Ewallet Direct's Service, declared by a higher legal entity of an account holder's jurisdiction. In a transaction dispute case deemed fraudulent, Ewallet Direct will investigate and (may) reverse transactions found to violate fair practice and/or are abusive towards other Ewallet Direct Users or the Ewallet Direct Service.

16.0 Account Termination

The following specific terms apply to account terminations:

  • Account holders must contact Customer Support to close their own account at Ewallet Direct Customer Service department by the Contact Us section on https://www.ewallet.direct/chp/web or by email at admin@ewallet.direct.
  • Accounts that were closed by an account holder's own request or from Ewallet Direct Customer Service cannot be re-opened. A new account will have to be created and current (valid) personal information and documentation must be provided. Ewallet Direct reserves the right to verify all information provided and copies of personal identification documents and proof of address prior to approving your account.
  • Ewallet Direct may terminate a User's account without prior notice if it's found to violate the terms of the Ewallet Direct User Agreement, or any of our Policies.
  • Ewallet Direct does not terminate accounts due to inactivity.
  • Accounts that have become inactive by virtue of no Ewallet Direct User activity (meaning no electronic fund transactions) after 12 months, then the User account shall be assessed a dormant inactive account fee on any funds residing in the account until such time as the User begins activity again or the account reaches a $0.00 balance. For inactive accounts already at a $0.00 balance, no fees shall apply. It is the sole responsibility of the User to keep their account active. Ewallet Direct shall not make notification to the User of impending account inactivity.

17.0 General Dislcosures

Ewallet Direct' goal is to provide a safe and fraud free environment for its Users. In that regard, Ewallet Direct provides the following General Disclosures:

  • Accounts that are suspected to be fraudulent or engage in fraudulent activity may be limited during an investigation. During the investigation the user will be asked to explain the specifics of the account activity in order to lift the limitation from the account.
  • If during the investigation the limited account proves to be fraudulent and involved in activities that are against Ewallet Direct's User Agreement or any other Policy, the limitation will not be lifted and the account may be terminated.
  • All business accounts are subjected to a temporary security freeze from incoming and outgoing transactions pending a review and decision on new account holder identity validation.
  • Ewallet Direct is not responsible for any misuse of the Service. Users shall verify the usability of this type of financial service within their jurisdiction or country of citizenship and residence.
  • Users must refrain from swearing, abusing or threatening other Ewallet Direct Users, Ewallet Direct, its shareholders, subsidiaries and affiliates (and their officers, directors, agents, joint ventures, employees and suppliers) either through email, support centre or live chat. Abusive conduct will not be tolerated and may result in account termination.
  • Ewallet Direct offers electronic payment services and is not a bank. Our Service facilitates a display of your electronic transactions.

18.0 Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF) Policy

Ewallet Direct is fully committed to conducting due diligence on our clients and ensuring that all applicable laws and regulations necessary to forestall and prevent money laundering. 
These include confirming the identity of our Users by means of:

  • Valid government-issued photo ID
  • Proof of residential (or business) address
  • Corporation documentation
  • Business registration information
  • Tax Identification Document
  • Any other applicable documentation

Furthermore, we reserve the right to conduct enhanced due diligence on all clients. Please note that Ewallet Direct reserves the right to refuse a transaction or deny operation to a client or account at any time should suspicion arise that it may be connected to money laundering, criminal activity or any other predicate offence to money laundering. Ewallet Direct will not enter into any business arrangement with anyone or group suspected of or directly involved in money laundering, or where funds have been from either the sources or ends of an illegal activity.

In the event that Ewallet Direct receives, during its request for documentation, deceptive documentation, contact details, business description or any other false information, Ewallet Direct will terminate the offending account immediately. Ewallet Direct is legally bound to report such misdemeanors to the relevant authorities, and as such the subject, business and its owners may be subject to a criminal investigation. Ewallet Direct participates fully in the regulated anti-money laundering rules and regulations of FINTRAC (Canada) and FINCEN (USA). For customers from the European Union the EU AML Regulations are applicable. Large transactions in excess of $10,000 USD or equivalent are required to be reported to appropriate government authorities. Users are under agreement to keep their accounts and contact information current at all times. Providing false, doctored, or deceptive documents is considered as fraud and will be treated as such. Tax evasion and fraud are predicate offences to Money Laundering, and therefore, all assets derived from fraudulent transactions or suspicious activity may be seized and forfeited.

18.1 Counter-Terrorism Financing Statement (CTF)

As part of the information that is collected during our verification and AML procedures, Ewallet Direct conducts verification through world-wide databases. This includes compliance with OFAC (Office of Foreign Asset Control) requirements, United Nations (UN) global sanctions reports and government watch-lists and rigorous screening processes. At any time, due to a requirement to satisfy any of the above verification methods, a client, business entity or any of the business entity owners or affiliates may be asked a specific document or piece of information to confirm their identity or provide additional information regarding any transaction, operations or even business dealings with certain individuals, institutions and dealings in geographical locations.

Should a situation arise where the nature of the business, geographical specific regulations or account activity fall in the scope of non-compliance in any applicable law or regulation, Ewallet Direct will inform the client, business unit or any of the business owners or affiliates of the event and occurrence(s). For any such instances, pre-verification and enhanced due diligence will be required prior to regaining active account status. In cases, where compliance is not achieved pursuing remediation measures, Ewallet Direct will see fit to terminate the account and may report the event to the applicable law enforcement and regulatory authorities.

19.0 General Terms

19.1 Independent Contractor

It is expressly agreed and understood that Ewallet Direct is an independent contractor and that there is no employer-employee relationship, partnership, joint venture or agency created hereby.

19.2 Severability

If any term, provision, covenant or condition of this Agreement is held by a Court of competent jurisdiction to be invalid, void or unenforceable, the remaining portions of this Agreement shall nonetheless remain in full force and effect and shall in no way be affected, impaired, and/or invalidated thereby.

19.3 Taxes

It is your responsibility to determine what, if any, taxes apply to the electronic fund payments that you make or receive, and it is your responsibility to collect, report and remit the correct tax to the appropriate tax authority in your jurisdiction or country. Ewallet Direct is not responsible for determining whether taxes apply to your transaction, or for collecting, reporting or remitting any taxes arising from any transaction. All fees related to the Ewallet Direct Service are made separate of any taxes, duties or other deductions from your personal bank account or your personal banking institution. Any such deduction or withholding, if required by the laws of any country you are banking with, is your sole responsibility.

19.4 Assignment

You may not transfer or assign any rights or obligations you have under this Agreement without our prior written consent. We reserve the right to transfer or assign this Agreement or any right or obligation under this Agreement at any time.

19.5 Copyright

Users shall only use Ewallet Direct's trademarks with the prior written permission from the Ewallet Direct administration. Users may not modify trademarks of Ewallet Direct. Failing to comply with Ewallet Direct copyright or trademark protection provisions will result in an immediate account termination.

19.6 Entire Agreement

This Agreement constitutes the entire agreement and understanding between parties hereto, and it is expressly understood and agreed that no representation, understandings and/or other agreements of any nature, whether oral or written, have been made by and/or relied upon by either party in the execution of this Agreement, other than those which are contained herein.
